TERMS AND CONDITIONS (T&C)

1. Scope of Application

(1) These Terms and Conditions apply to all orders placed via the online shop lucaro-tools.com.
(2) The provider is:

(hereinafter referred to as “Provider”)

(3) The offer is directed to both consumers within the meaning of Directive 2011/83/EU and entrepreneurs within the meaning of Directive 2006/112/EC.
(4) A consumer is any natural person acting for purposes outside their trade, business, craft or profession.
(5) An entrepreneur is any natural or legal person acting in the exercise of their trade or independent professional activity.

2. Contract Language and Applicable Law

(1) The contract language is Bulgarian.
(2) The law of the Republic of Bulgaria shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(3) Mandatory consumer protection provisions of the consumer’s country of residence within the EU remain unaffected.

3. Conclusion of Contract

(1) Product presentations in the online shop do not constitute legally binding offers but an invitation to submit an order.
(2) By clicking the “Buy Now” button, the customer submits a binding offer to conclude a purchase contract.
(3) The contract is concluded upon order confirmation by email or dispatch of the goods.
(4) The contract text is stored and sent to the customer by email.

4. Prices and Payment Terms

(1) Prices are displayed depending on the selected delivery country in EUR, BGN or RON.
(2) On product and category pages, prices are displayed including the standard Bulgarian VAT of 20%.
(3) For deliveries within the EU, VAT is calculated according to the VAT regulations of the destination country (destination principle pursuant to the EU VAT Directive).
(4) After selecting the delivery country in the cart, the applicable VAT rate of the respective EU Member State is automatically calculated and the final price adjusted. The total price displayed in the cart is binding.
(5) For entrepreneurs providing a valid VAT identification number, VAT-exempt intra-Community supply may apply subject to legal requirements.
(6) Shipping costs are displayed separately.
(7) The purchase price is due immediately upon conclusion of contract unless otherwise agreed.

5. Delivery

(1) Delivery is made to the address specified by the customer within the EU.
(2) If a product is unavailable, the customer will be informed immediately and payments refunded.
(3) For consumers, the risk of loss or damage passes upon delivery of the goods.
For entrepreneurs, the risk passes upon handover to the carrier.

6. Retention of Title

Goods remain the property of the Provider until full payment is received.
For entrepreneurs, ownership remains until settlement of all outstanding claims.

7. Right of Withdrawal (Consumers)

(1) Consumers have the right to withdraw within 14 days without giving reasons.
(2) The withdrawal period is 14 days from receipt of the goods.
(3) Withdrawal must be declared by a clear statement to the Provider.
(4) The consumer bears return shipping costs.
(5) No right of withdrawal exists for:
– custom-made goods
– unsealed hygiene products
– perishable goods
– unsealed software
(6) Refunds are made within 14 days of receipt of withdrawal notice.

8. Warranty

(1) Consumers benefit from statutory warranty rights.
(2) For entrepreneurs, the warranty period is 12 months from delivery.

9. Data Protection

Personal data is processed in accordance with the GDPR and the separate privacy policy.

10. Online Dispute Resolution

The European Commission provides an ODR platform:

The Provider is not obliged to participate in dispute resolution proceedings.
